Supreme Court to extend mediation system to six more townships

The Union Supreme Court will extend a mediation system to six more township courts starting in March after pilot tests in four courts successfully resolved legal cases before going to trial, a court official said.

Daw Ohnmar Aye, deputy director of International Relations and Research for the Union Supreme Court, said that if the system is successful in the six township courts, it will be implemented nationwide.

She said the mediation system was tested last year in three mediation centers for four courts in the nation’s capital, Nay Pyi Taw, and in Taungoo township in Bago Region.

“The Supreme Court aims to extend the system across the country eventually,” she said.

The try-out of the system is part of the Five-Year Judicial Strategic Plan (2018-2022) that was drafted to provide justice for all, increase public trust in the courts, and ensure rule of law.

The Japan International Cooperation Agency (JICA) is providing technical assistance in the project, including the training of court officers. Only civil cases about finance, family and trade matters can undergo mediation.

Iwai Tomoyuki, the chief adviser to the project, said that the court-led mediation system reduces costs and saves time compared to a full trial.

“It is a mechanism that Myanmar law needed. The mediation system is a perfect way to handle family and financial problems, such as divorce cases,” he said.

According to the Supreme Court, the three centers handled 449 cases from March to December 2019 and solved 110 through mediation.

“In the next phase, we will not open new centers at each court. Instead, I will open one new office at Dekkhina district court to handle the cases of six courts,” Daw Ohnmar Aye said.

The system will be extended to the township courts of Dekkinathiri, Ottarathiri, Pobbathiri, Lewe, Pyinmana and Zabuthiri townships, all in Nay Pyi Taw.
