Foreign investors that invest under Foreign Investment Law (FIL) scheme can lease land from the government for 50 years and then extend it for another 20 years with two 10 year extensions.
Under the law private land owners can lease land to foreign investors subject to approval of the relevant ministries.
For your information, most foreign-owned hotels in Myanmar are built on a built, operate and transfer (BOT) model i.e. after the lease period the hotel is transferred to the owner of the land.
Under the law, it is illegal for foreigners to own land in Myanmar. Should a foreigner acquire Burmese land via a local proxy – in the event of a dispute the foreigner will have no recourse under Burmese law.
The current condominium law does not allow foreigners to buy property as well.
